President Trump this week signed several executive orders aimed at regulatory relief at both the federal and state levels. The executive orders are a welcome development as NAHB has been working closely with the administration to reform the federal rulemaking process and eliminate excessive regulations.

Of note to the housing industry, the EOs include:

  • Removing state-level impediments to domestic energy production, with a focus on climate change policies; policies involving environmental, social, and governance initiatives, carbon or greenhouse gas emissions; and funds to collect carbon penalties or carbon taxes.
  • Rescinding unlawful regulations based on the outcomes of 10 recent landmark Supreme Court decisions, such as:
  • Establishing a “Conditional Sunset Date” for certain regulations to ensure agencies re-examine their regulations periodically to ensure that those rules serve the public good.

NAHB staff is reviewing these EOs to determine their potential impact and next steps.

In addition, the Trump administration recently established a “deregulation suggestions” webpage where members of the public can enter details of existing rules or regulations they believe should be rescinded. The form can be found at regulations.gov.

NAHB has been actively working with the Trump administration on housing policy priorities related to these and other issues, and will continue to work to roll back regulatory costs.
